Can Disney Steal Someone Elses Character?

Hi Guys!:heart:

My question today is "Can Disney steal someone elses character and get away with it?" I mean being an artist myselve I realise how much time and energy it takes to breath life into a an artistic piece, photographic, pencil or otherwise. And to have a major corporate thug come along and nick it and not even mention that they are going to take your character, leaves me personally sickened. I am talking about :iconkingmukatan: After, you read the Journal entry tell me what you think. "Should we boycott the new 'Tinkerbell movie'?" I will keep you posted once I hear future developments.




'Wow!" :wow: Moving on to the Olympics......'What about Micheal Phelps!" Human Dymo!:winner: The US last I heard was barreling ahead in the Medal tally and Australia, so small in comparision is right behind the US. I love watching peoples personal achievements, too conquer within themselves personal barriers and limits, to strive for the ultimate achievements.:winner:




I would like to announce the sad loss of my camera cover or case last night somewhere out on my Island, proudly being chewed by a buffalo/bison right at this present. It was a true friend, it covered my camera all over Australia :iconaustralia: and most parts of the lower 48 of the USA :iconamerican: Now I have to get another. So dumb how you get attached to things:giggle:



This world is such a beautiful place and such a blaze of colour.:earth: Here is a taste of the breathtaking, colourful world we all share, and need to look after for our future generations to apprecaite and enjoy.:sun:

Yes, the idea was stolen, but it looks like it's been changed enough, to say that it will stand up in a court of law as no infringement on a copyright. It really would be up to the court to decide which way it would be settled. ATTACK THE CORPERATE GIANT! I say he should win! tHIS IS THE PROBLEM WITH THE LAWLESS INTERNET. Thier are a lot of good ideas floating around that can be taken without notice. I hope he sues! I hope he wins! Slay the monster!

Well yes, whoever's got the best lawyers usually wins. However, I don't see much of a resemblance, and I think if I were the judge I'd need more than the pics to take your friend's side in a case. A lot of people don't realize that coincidences happen. Just because something looks like it was copied doesn't mean that it was. BTW, I'm not sticking up for Disney; given their position on intellectual property (owner basically keeps it forever), I completely do not have any sympathy for any ill will that comes their way.

I hear you, your comments make alot of sense. I am virtually sitting on the fence with this one until the verdit comes through, then I will make up my mind. It has been interesting gauging peoples opinions in regards to this.

I don't think it looks like his character at all. The hair is WAY different. Similar only in color. Goggles are different. Personality stances and the like are different. His character looks confident, Disneys looks clumsy and unsure. In fact, it looks like a collaboration of a bunch of older disney characters. It looks like a combo of Milo from Atlantis, Spud from the most recent The Borrowers movie, Willy Wonka (when he puts on those ridiculous glasses). Many of the characters from Arthur and the Invisables, and of course, Lewis from Meet the Robinsons.

A character is created by a BUNCH of artist. The head of the character design then takes what he likes from EACH artist. Well, not each, but most. He will not just pick one he likes best.

My character Willow looks and acts exactly like the main girl character from the new movie, Enchanted. However I doubt they STOLE the idea from me.

And my star wars character looks exactly like your friend Makutan, and I have NEVER seen or heard of this Makutan guy in my entire life. I really doubt it was stolen. If my character was stolen and made into a Disney character, I'd be so freakin excited. To know that I have ideas that Disney is using.

If he is soo upset about it, then oviously he needs to do something about it and stop whining about it here.

Also, your friend has only been a member since 2007, meaning his art has only been up for a year. Disney movies take YEARS to do. The concepts are ideas, the very first step to take, usually made years before the movie is actually released. Meaning that this disney character has been around longer than your friend. And since it's an animated pixar type movie, it's probably been in the works for about three-four years now.

Brilliant reply your comment made the most sense out of all the comments I have received. My initial reasoning to pose such a question was to gauge the overall reation of people in the DevaintArt areana. Presently, there is alot of art thif going on, certianly no different circumstances have occured in the past.

I have also heard stories about Disney, in regards to their standover tatics in regards to their use of their characters. So when a problem like has arisen like noted here on DevaintArt, it does leave room to ponder considering those circumstances.

The only time Disney has ever stolen anything was The Lion King. The origional was Kindra the White Lion. It was a popular japanese comic. However, that is also a rumour and it seems that Japan comic company didn't care, or perhaps Disney bought the idea.

There are some questionable things they've done in the past, like hidden pictures and the like. However, Disney knows it has to be more careful these days, anything can set anyone off. Anything can get them sued.

Disney has big money, a law suit to them is a drip in the bucket, as in regards to moneywise. However, reputation wise is a nother thing all together. But they have the best lawyers its a bit like 'Money talks Poverty walks".
